ARTICLE 370 REVOKED - JAMMU & KASHMIR ఆర్టికల్ 370 రద్దు- జమ్మూ కాశ్మీర్ ప్రత్యేక హోదా రద్దు- 3 భాగాలు (కేంద్ర పాలిత ప్రాంతాలు) గా విభజన
భారత రాజ్యాంగం లోని 1వ ప్రకరణ లేదా ఆర్టికల్ ప్రకారం జమ్మూ కాశ్మీర్ రాష్ట్రం కూడా భారతదేశం లో రాష్ట్రమే . ఐతే భారత రాజ్యంగంలో 21వ భాగంలోని 370 ఆర్టికల్ జమ్మూ కాశ్మీర్కు ప్రత్యేక హోదా కల్పించింది . ఈ ఆర్టికల్ ప్రకారం భారత రాజ్యాంగంలోని అన్ని ఆర్టికల్స్ ఈ రాష్ట్రానికి వర్తించవు . అంటే జమ్మూ కాష్మీర్ కి ఇచ్చిన ప్రత్యేక హోదా ఏ ఇతర రాష్ట్రాలకు లేనిదీ, పోల్చలేనిది, ప్రత్యేకమైనది.
బ్రిటిష్ వారి ఆధిపత్యం అంతమైన తరవాత 1947 ఆగష్టు 15 న జమ్మూ కాశ్మీర్ స్వాతంత్య్రం పొందింది. అయితే జమ్మూ కాశ్మీర్ పాలకుడైన మహారాజు హరిసింగ్ జమ్మూ కాశ్మీర్ ని భారతదేశంలో గాని, పాకిస్థాన్ లో గాని విలీనం చేయుటకు అంగీకరించలేదు. కాగా 1947 అక్టోబరు 20 నాడు పాకిస్థాన్ సైన్యం సహాయంతో ఆజాద్ కాశ్మీర్ దళాలు జమ్మూ కాశ్మీర్ సరిహద్దుల్లో దాడి చేసారు. అప్పుడు హరిసింగ్ జమ్మూ కాశ్మీర్ రాష్ట్రాన్ని 1947 అక్టోబర్ 26న విలీన ఒప్పందం ద్వారా జమ్మూ కాశ్మీర్ రాష్ట్రాన్ని భారతదేశం లో విలీనం చేసాడు.
జమ్మూ కాశ్మీర్ కి సంబంధించి ప్రత్యేక హోదా కి సంబంధించిన అంశాలలో కొన్ని పరిశీలిస్తే,
* ఆర్టికల్ 238 లోని అంశాలు (పార్ట్-బి రాష్ట్రాల పరిపాలనకు సంబంధించింది ) జమ్మూ కాశ్మీర్ కి వర్తించవు. ఎందుకంటే 1956వ సంవత్సరం లో రాష్ట్రాల పునర్విభజన సందర్భంగా చేసిన 7వ రాజ్యాంగ సవరణ చట్టం ద్వారా ఆర్టికల్ 238 ను తొలగించారు.
* భారత రాజ్యాంగం లోని 1వ ఆర్టికల్ ( భారత దేశం ఒక రాష్ట్రాల యూనియన్ మరియు దాని భూభాగం ) లోని అంశాలు జమ్మూ కాశ్మీర్ కి వర్తిస్తాయి.
* భారత పార్లమెంట్ కు జమ్మూ కాశ్మీర్ కి సంబంధించి శాసన అధికారం పరిమితమైనది. పార్లమెంట్ శాసనం చేసే అంశాలను జమ్మూ కాశ్మీర్ రాష్ట్ర ప్రభుత్వం తో సంప్రదించి రాష్ట్రపతి ప్రకటించాలి.
* ఆర్టికల్ 370 ని తొలగించే అధికారం గాని, సవరించే అధికారం గాని భారత రాష్ట్రపతి కి కలదు. ఈ అధికారం తోనే భారత ప్రభుత్వం ఆర్టికల్ 370, 35 A లను రద్దు చేసింది. కానీ జమ్మూ కాశ్మీర్ రాజ్యాంగసభ సూచనల ప్రకారం రాష్ట్రపతి నిర్ణయం తీసుకోవాలి.
అంటే భారత రాజ్యాంగంలో 1వ ఆర్టికల్, 370 ఆర్టికల్ లు రెండు జమ్మూ కాశ్మీర్ కి వర్తిస్తాయి. అంతేగాక ఇతర ఆర్టికల్స్ ని వర్తింపజేసే అధికారం రాష్ట్రపతికి కలదు.
అయితే ప్రస్తుతం జమ్మూ కాశ్మీర్ ని చట్ట సభలు ఉన్న కేంద్రపాలిత ప్రాంతాలుగా జమ్మూ, కాశ్మీర్, మరియు లడఖ్ చట్టసభ లేని కేంద్ర పాలిత ప్రాంతంగా విభజించారు.
